Adult Rider Release Form

GEORGIA PRACTICE FACILITY (GPF), KTB Real Estate, and SK Holdings WAIVER AND RELEASE OF LIABILITY AGREEMENT IN CONSIDERATION of being allowed to participate in any way at Georgia Practice Facility (“GPF”) ("EVENT"):

I UNDERSTAND AND AGREE that although I have been supplied with certain information about the riding areas, I am not permitted to inspect the full course or any portion of the practice or event area prior to participation. I agree that if at any time I believe anything to be unsafe or unsatisfactory in any way, I will immediately take all necessary precautions to avoid the area and/or withdraw from participation.


I HEREBY RELEASE, WAIVE, DISCHARGE AND COVENANT NOT TO SUE Georgia Practice Facility (GPF), KTB real estate, SK holdings, including its owners, managers, staff, landowners, riders, participants, officials, rescue personnel, sponsors, advertisers, contractors, and all other affiliated individuals or organizations (“RELEASEES”), FROM ALL LIABILITY to myself, my personal representatives, heirs, and next of kin, FOR ANY LOSS OR DAMAGE, OR CLAIMS ARISING FROM INJURY, DEATH, OR PROPERTY DAMAGE, whether caused by the negligence of the RELEASEES or otherwise, related in any way to my presence at or participation in activities at GPF.


I HEREBY AGREE TO INDEMNIFY AND SAVE AND HOLD HARMLESS the RELEASEES from any and all loss, liability, damage, or cost (including attorney fees) arising out of or related in any way to my presence or participation at GPF, regardless of negligence.


I ASSUME FULL RESPONSIBILITY for any risk of bodily injury, death, or property damage related to my participation at GPF, whether caused by the negligence of the RELEASEES or otherwise.


I ACKNOWLEDGE that the activities at GPF are dangerous and involve serious risks, including injury, death, and property damage. I further acknowledge that INJURIES MAY BE COMPOUNDED OR INCREASED BY NEGLIGENT RESCUE OPERATIONS OR PROCEDURES of the RELEASEES.


I AGREE that this Waiver and Release of Liability, Assumption of Risk, and Indemnity Agreement applies to all acts of negligence by the RELEASEES, including negligent rescue efforts. This agreement is intended to be as broad and inclusive as permitted by the laws of the State of Georgia, and if any part is held invalid, the remainder shall continue in full force and effect.


I AGREE that this agreement is binding upon me, my personal representatives, agents, heirs, successors, and assigns, and is enforceable to the fullest extent permitted by law.

THIS AGREEMENT SHALL BE INTERPRETED UNDER THE LAWS OF THE STATE OF GEORGIA.
If any part of this Agreement is adjudged invalid for any reason, the remaining terms shall remain enforceable.

I HAVE READ THIS WAIVER, RELEASE OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNITY AGREEMENT. I understand its terms and acknowledge that I am giving up substantial legal rights by signing it. I am signing this agreement freely and voluntarily without inducement, assurance, or guarantee. I intend my signature to be a complete and unconditional release of all liability to the greatest extent allowed by law.
