Minor Rider Release Form
MINOR WAIVER, RELEASE OF LIABILITY, AND INDEMNITY AGREEMENT
IN CONSIDERATION of allowing the below MINOR participant to enter, observe, train, ride, or participate in any way at the Georgia Practice Facility (“GPF”) and/or being permitted to enter for any purpose any RESTRICTED AREA (defined as any area requiring special authorization, credentials, or permission to enter, or any area to which access by the general public is restricted or prohibited, including but not limited to riding areas, tracks, and pit areas), EACH OF THE UNDERSIGNED, for themselves, their personal representatives, heirs, and next of kin agree as follows:
1. INSPECTION AND ACCEPTANCE OF RISK
The MINOR and PARENT/GUARDIAN will immediately inspect the RESTRICTED AREA upon entering and affirm that their entry and/or participation constitutes an acknowledgment that they have found it to be safe and reasonably suited for the intended use. If at any time they believe anything to be unsafe, they will immediately notify a GPF official and remove themselves and the MINOR from the RESTRICTED AREA and discontinue further participation.
2. ASSUMPTION OF RISK
The MINOR and PARENT/GUARDIAN hereby assume full responsibility for, and all risks of, bodily injury, death, or property damage arising from their presence at GPF and/or participation in any facility-related activities, whether caused by the negligence of GPF, its owners, staff, volunteers, or any other participants (“RELEASEES”), or otherwise. They understand the risks involved in motocross and off-road activities, including but not limited to severe injuries, paralysis, or death, and knowingly accept these risks.
3. RELEASE AND WAIVER OF LIABILITY
The MINOR and PARENT/GUARDIAN hereby release, waive, discharge, and covenant not to sue Georgia Practice Facility, its owners, operators, employees, volunteers, landowners, track builders, equipment manufacturers, sponsors, agents, and all others involved in the operation or oversight of the facility (“RELEASEES”) from any and all liability, claims, demands, or causes of action for any loss or damage, and any claim or demands arising from injury, death, or property damage related to the MINOR or parent/guardian’s participation at GPF, whether caused by negligence or otherwise.
4. INDEMNIFICATION
The PARENT and/or GUARDIAN agree to indemnify and hold harmless the RELEASEES from any loss, liability, damage, or cost incurred due to the presence or participation of themselves or the MINOR at GPF, including those caused by negligence. This agreement is binding on the parent/guardian individually and on behalf of the MINOR.
5. SEVERABILITY AND GOVERNING LAW
This agreement is intended to be as broad and inclusive as permitted by the laws of the State of Georgia. If any provision is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
BY SIGNING BELOW, I acknowledge that I have read and voluntarily agree to this waiver, release of liability, and indemnity agreement, and understand that I am giving up substantial legal rights on behalf of myself and the MINOR. I further acknowledge that failure to witness or notarize this agreement does not affect its enforceability.
