GEORGIA PRACTICE FACILITY (GPF), KTB Real Estate, and SK Holdings WAIVER AND RELEASE OF LIABILITY AGREEMENT

IN CONSIDERATION of being allowed to participate in any way in training, riding, spectating, or other activities at the Georgia Practice Facility (“GPF”) ("EVENT"):

I UNDERSTAND AND AGREE that although I have been provided with information regarding the Event and its environment, GPF does not permit me to inspect the full course or areas adjacent to it prior to my participation. I understand and agree that if I believe anything is unsafe or unsatisfactory in any way, I will immediately take all necessary precautions to avoid that area and/or remove myself from participation.

I HEREBY RELEASE, WAIVE, DISCHARGE, AND COVENANT NOT TO SUE Georgia Practice Facility (GPF), KTB real estate, SK holdings, its owners, employees, staff, contractors, sponsors, landowners, volunteers, event personnel, officials, track builders, and all other persons or entities associated with GPF operations (collectively referred to as “RELEASEES”) FROM ALL LIABILITY TO THE UNDERSIGNED, including personal representatives, heirs, and next of kin, for any and all loss or damage and any claims or demands related to injury, death, or property damage, WHETHER CAUSED BY NEGLIGENCE OF THE RELEASEES OR OTHERWISE.

I HEREBY AGREE TO INDEMNIFY AND HOLD HARMLESS the RELEASEES from any loss, liability, damage, or costs (including legal fees) that may arise from my presence or participation at GPF, whether caused by negligence or otherwise.

I ASSUME FULL RESPONSIBILITY for any risk of bodily injury, death, or property damage related to my presence at or participation in activities at GPF, whether caused by the negligence of RELEASEES or otherwise.

I ACKNOWLEDGE that riding and training at GPF is inherently dangerous and involves the risk of serious injury or death. I further understand that INJURIES MAY BE COMPOUNDED BY NEGLIGENT RESCUE OPERATIONS OR PROCEDURES OF THE RELEASEES.

I AGREE that this Release and Waiver of Liability extends to all acts of negligence by the RELEASEES, including negligent rescue operations, and is intended to be as broad and inclusive as permitted by Georgia state law. If any part is found invalid, the remaining provisions shall continue in full force and effect.

I AGREE that this agreement is binding and enforceable against me, my spouse, heirs, legal representatives, agents, and assigns, without limitation.

THIS AGREEMENT SHALL BE INTERPRETED UNDER THE LAWS OF THE STATE OF GEORGIA. If any part is deemed invalid, the remainder will still be enforceable.
